A power struggle for control of the NHS in England was disclosed yesterday in top-level correspondence seen by the Guardian. David Nicholson, the NHS chief executive, was accused of breaking the law by issuing instructions to foundation hospitals that infringe their independence. In a strongly-worded letter, the watchdog for the fledgling institutions warned that their freedom to operate outside Whitehall control is being eroded by centralists at the Department of Health.
